Terms of Service.

1. Acceptance

By signing up for, or otherwise using, Mailnurse, you agree to these terms. If you do not agree to these terms, you may not use the service. These terms form a binding agreement between you (the "Customer") and Mailnurse.

2. The service

Mailnurse monitors customer-authorized cold-email sending accounts — mailboxes, sending domains, and connected ESP integrations — and automates infrastructure responses (alerts, account pauses, domain rotations) according to the rule configuration the customer has set. The service is provided on a subscription basis, on the tiers listed at mailnurse.io/pricing.

3. Your account

When you create a Mailnurse account, you accept the following responsibilities:

  • You will keep your account credentials secure and notify us promptly of any unauthorized access.
  • You are responsible for the API keys and OAuth tokens you grant to Mailnurse and for revoking them if your access to the underlying provider ends.
  • You are solely responsible for the legality of your cold-email sending under the applicable law of every jurisdiction in which you operate (including CAN-SPAM, GDPR, CASL, and PECR). Compliance with sending regulations is your obligation, not Mailnurse's.
  • You are responsible for keeping your billing information accurate and up to date.

4. Acceptable use

You may not use Mailnurse to:

  • Monitor sending accounts you do not own or do not have explicit permission to monitor.
  • Facilitate spam, phishing, malware distribution, fraud, or any other illegal communication.
  • Reverse-engineer, decompile, or extract the source code of the Mailnurse service.
  • Resell or sublicense access to Mailnurse without a written reseller agreement signed by us.
  • Exceed the sending-account limit of your tier by more than ten percent without upgrading.
  • Interfere with the integrity or performance of the service, or with the use of the service by other customers.

5. Subscriptions, billing, refunds

Subscriptions are paid in advance — monthly or annual — via Stripe. They auto-renew at the end of each period unless canceled. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for the unused remainder. 6. Trial period

New customers receive a fourteen-day free trial with full access to the Pro tier. No credit card is required to start a trial. At the end of the trial, the customer chooses a paid plan or the account downgrades to a read-only state. There are no surprise charges; we do not bill a card we never collected.

7. Service availability

We target a monthly uptime of 99.9% on paid tiers. Scheduled maintenance is announced at least 48 hours in advance via our status page at status.mailnurse.io. Unscheduled incidents are also reported there in real time.

8. Intellectual property

Mailnurse owns all rights, title, and interest in the service, its software, brand assets, and documentation. You own your data and your sending infrastructure. You grant Mailnurse a limited, worldwide, non-exclusive license to process your telemetry strictly for the purpose of delivering the service to you.

9. Confidentiality

Both parties agree to treat the other's confidential information as confidential, to use it only in connection with the service, and to protect it with at least the same degree of care they apply to their own confidential information. A mutual NDA is implied by use of the service.

10. Liability

Mailnurse's aggregate liability under or arising out of this agreement is capped at the fees paid by the Customer to Mailnurse in the twelve months preceding the claim. Neither party is liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost data. In plain English: if we cause a problem, we refund up to a year of payments — we do not pay for downstream business losses.

11. Indemnification

You will defend, indemnify, and hold harmless Mailnurse and its affiliates against any third-party claim arising from your misuse of the service or your violation of the acceptable-use policy in section 4.

12. Termination

Either party may terminate this agreement for material breach with thirty days' written notice, provided the breach has not been cured within that window. Mailnurse may terminate immediately for violations of the acceptable-use policy. On termination, customer data is exportable for thirty days before being hard-deleted.

13. Governing law

This agreement is governed by the laws of Belgium. Any dispute arising under or in connection with this agreement is subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.

14. Changes to these terms

When we make material changes to these terms, we notify customers by email and post a banner on the marketing site at least thirty days before the change takes effect. Continued use after the effective date constitutes acceptance of the updated terms. Historical versions are available on request.
